Conspiracy to Commit an Offense or to Defraud the United States is a crime under Federal Law. The Offense is found in 18 United States Code Section 371. This section provides pertinent parts as follows:
If two or more persons conspire either to commit any offense against the United States, or to defraud the United States, or any agency thereof in any manner or for any purpose, and one or more of such persons do any act to effect the object of the conspiracy, each shall be fined under this title or imprisoned not more than five years, or both
Successfully Defending Federal Conspiracy Charges
I have tried and won different federal conspiracy cases. One defense that works shows no relationship between my client and the other alleged co-conspirators. More precisely, the defense is that my client may have known the alleged conspirators, but he or she never engaged in any agreement with them to break the law. One can know someone without conspiring with them to break the law. One can be around someone conspiring to break the law without joining in the conspiracy. Under the law, Mere Presence is not enough to make someone guilty of participating in a federal conspiracy.
Here are some examples of winning defenses:
- I won one conspiracy case by showing my client was simply an employee at a legitimate business, I showed that there was no evidence that my client was aware that the boss was engaged in criminal conduct.
- I won another conspiracy case where my client dated the primary suspect. I showed that my client had dated the primary suspect in the past. I showed that my client had broken up with the primary suspect before the conspiracy began. I showed that by the time the conspiracy began, she was not in communication with the primary suspect, and as an “ex,” my client would be the last person the primary suspect would trust. In this case, the Government agent took written confessions from two other suspects. He then claimed that my client gave him an oral confession. I attacked his claim at trial and asserted that my client did not confess. I showed that if she had made a confession, like the other two, he would have had her write it down.
- I won other conspiracy cases by showing that the Government’s snitches, informants, or cooperating defendants were liars and not worthy of the jury’s belief. I demonstrated to the jury that the snitches, informants, or cooperating defendants had lived a life of lies and, therefore, the jury should not believe them. On cross-examination of the snitch, I went through their lives, showing how they had lied for years to everyone, from their mother to their probation officer.
I used a flip chart to chronicle their life of lies. I call it the “List of Lies.” My colleagues like the technique. For years, I have been invited to teach other defense lawyers how to effectively cross-examine snitches, Government informants, and cooperating defendants.
